This privacy notice lets you know what happens to any personal data that you give to us, or any that we may collect from or about you. It applies to all products and services offered by The UK FCS Ltd and it’s trading styles; The UK FCS and UK FCS Wills & Estate Planning

1. Whose data do we collect?

We collect data of business to business clients, private clients and prospects, business partners, services providers, business prospects and other professional affiliates, in connection with providing commercial or private services, either via a third-party supplier or by us, The UK FCS Ltd and/or through one of its trading styles.

 

2.How do we collect data?

Most of the information we hold about you has been provided directly to us by you. For example, if you fill out a registration or subscription forms on one of our websites www.theukfcs.com and www.ukfcswills.com.

Occasionally we may be provided with information by a third party that we may be working with. For example, we may be provided with contact details by a partner who is referring business to us.

We will also collect data that you have provided to us directly either over the telephone, in person, via a business card you have given to us or by email.

Other data we collect includes when you have completed an application form or signed a Terms of Business linked to one of our trading styles.

 

3. What data do we collect?

Personal information that we’ll handle in connection with all of our products and services, specifically of relevance to ‘clients’ who have done business directly or indirectly with The UK FCS, or any one the trading styles.

  • Personal and contact details, such as title, full name and contact details.

  • In the cases of our clients, it is necessary for us to hold information on your date of birth, gender and/or age.

  • Your nationality, if required for the product or service.

  • Details of beneficiaries, particularly in relation to UK FCS Wills & Estate Planning Service

  • Family members (if relevant to the product or service)

  • Records of your contact with us including correspondence letters and/or emails

  • Products and services you hold with us, as well as have been interested in and have held and the associated payment methods used

  • Information about your use of products or services held with our business partners or us

  • Information about your health or if you are in a vulnerable position, particularly in relation to Wills and Estate Planning products

  • Information about your property, such as location and value

  • Financial details about you, such as your salary and details of other income, details of your savings, details of your expenditure and payment methods

  • Details of your existing borrowing and loans

  • Bank details and payment terms where applicable

 

4. What is the source of your personal information

 We’ll collect personal information from the following general sources:

  • From you directly

  • Information you input via any one of our websites www.theukfcs.com and www.ukfcswills.com

  • From business partners, third party providers, business affiliates and service providers we work with, or others who are part of providing your products and services

  • Whilst we will no longer purchase data from third party providers, we may hold existing data which was purchased via a third party provider previously. We have ensured we have made contact for GDPR purposes. 

  • From lead generation sources

 

5. What do we use your personal data for?

We use your personal data, including any personal data listed in section 1, for the following purposes:

  • Assessing an application for a product or service you hold with us, including considering whether or not to offer you the product or service, the price, the risk of doing so, availability and payment method and terms;

  • To complete an application

  • To purchase a property or sell a property

  • Updating your records

  • Managing any aspect of the product or service

  • To improve the operation of our business and that of our business partners

  • For management and auditing of our business operations including accounting

  • For direct marketing, where you have given us explicit permission to do so, relating to new products and services offered by any one of the trading styles listed. We’ll send marketing to you via your preferred method of contact.

  • To provide personalised content and services to you from a sales perspective, rather than a marketing perspective

  • To share information that is necessary to provide to our business partners where you have done business with them through us as your conduit

 

6. What are the legal grounds for our processing of your personal information (including when we share it with others)?

1) Where it is needed to provide you with our products and services such as:

a) Assessing an application for a product or service you hold with us, including considering whether or not you are eligible for the product or service, the price, the payment methods available and the conditions to attach

b) Managing products and services you hold with us, or an application for one

c) Updating your records

d) Sharing your personal information with business partners where necessary and service providers when you conclude a piece of business with us

e) To provide a good level of service to you

2) Where it is in our legitimate interest to do so, such as:

a) Managing your products and providing a good level of service to our clients

b) Following guidance from regulatory bodies where applicable

c) For market research if we were to conduct any

d) For direct marketing where you have given us consent and via your preferred contact method

e) When we are required to share your personal information with a business partner or service provider for financial, regulatory or in order to conduct the business

8. How and when you can withdraw your consent?

9. What should you do if your personal information changes?

10. Do you have to provide information to us?

For marketing purposes, no. However, in order to complete an application, and for us to supply you with products and services, we do need certain information from you which will be necessary to complete the application, particularly and often in relation to anti-money-laundering checks.

 

11. How is your information stored?

We utilise an online, cloud-based technology which is password protected, backed-up and encrypted. This is our electronic filing system and only accessed via employees of The UK FCS Ltd.

We hold some physical client files at our office premises which are securely stored in locked cabinets, on a gated community, in a locked office.

 

12. How long do we store information?

Unless we are advised by you to do otherwise, we’ll hold your personal information based on the following criteria:

  • For as long as we have reasonable business needs, such as managing our relationship with you and managing our operations

  • For as long as we provide services to you

  • Retention periods in line with legal and regulatory requirements or guidance

 

13. What are your rights under data protection laws?

Here is a list of the rights that all individuals have under data protection laws. They don’t apply in all circumstances. If you wish to use any of them, we’ll explain at the time if they are engaged or not. The right of data portability is only relevant from May 2018.

Including:

  • The right to be informed about your processing of your personal information

  • The right to have your personal information corrected if it is inaccurate and to have incomplete personal information, completed

  • The right to object to the processing of your personal information

  • The right to restrict processing of your personal information

  • The right to have your personal information erased (the “right to be forgotten”).
